Actions Taken by the Board of Cemeterians at its August 28 Meeting

Atlanta—The State Board of Cemeterians held its monthly meeting on August 28 to discuss the following cases:

  • The Board closed the following cases without action:

    • Monte Vista Biblical Gardens, ENCM-00221: No violation.

    • Evergreen Memorial Gardens, ENCM-00243: Issue resolved.

    • Lincoln Cemetery, Inc., ENCM-00244: Issue resolved.

    • Hillcrest Abbey West, ENCM-00245: No evidence of fault by the cemetery.

  • The Board referred the following case to the Attorney General for a declaratory ruling to determine if the Cemetery Act applies to the business:

    • Harden’s Chapel Cemetery, Inc., ENCM-00207

  • The Board also instituted formal administrative proceedings in the following cases:

    • Magnolia Memorial Gardens, ENCM-00248: Alleged sales practice issue. Cease and desist order and a fine are proposed.

    • Hillcrest Abbey West, ENCM-00181: Alleged maintenance issue. Cease and desist order and a fine are proposed.

    • Hillcrest Abbey East, ENCM-00239: Alleged maintenance issue. Cease and desist order and a fine are proposed.

    • Chestnut Hill Cemetery, EN-20115: Alleged failure to file change of ownership. Cease and desist order and a fine are proposed.

    • Moody Memorial Park, ENCM-00130: Alleged failure to file change of ownership. Cease and desist order and a fine are proposed.

Respondents in these matters will be sent a notice and proposed order, providing an opportunity for further negotiation and a formal hearing before final action is taken.

The Board also voted on the following issues:

  • The Board will allow the Office of the Secretary of State to engage in negotiations with respondents in administrative cases, after giving notice to the Board chairman, but all final resolutions must be approved by the Board

  • The Office of the Secretary of State will notify the Board of any registration application deficiencies that are not resolved within 30 days.

The next meeting of the State Board of Cemeterians is scheduled to be held on Tuesday, September 25.
