Georgia Secretary of State Brian Kemp Releases Final Decisions on Multiple Candidate Challenges

Secretary of State Brian Kemp signed final orders on the following Candidate Challenges on Friday July 20, 2012:

Brian Kemp v. Anne Taylor

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and held that Anne Taylor does not meet the residency requirements to be a candidate for the Georgia House of Representatives in District 39.

Since there is insufficient time to strike Anne Taylor's name or reprint the ballots, a prominent notice will be placed at each affected polling place advising voters of Anne Taylor's disqualification. All votes cast for Anne Taylor will be void and not counted.

David Wayne Morgan v. Paulette Braddock

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and dismissed the challenge to Paulette Braddock's qualifications to be a candidate for the Georgia House of Representatives in District 19.

Barry Lane Fitzpatrick v. John Christopher NeSmith

Secretary Kemp dismissed the challenge to John Christopher NeSmith as a result of Mr. NeSmith's voluntary withdrawal of his candidacy.

William Heath Jr. and William Houston v. William Carruth

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and held that William Carruth is qualified to be a candidate for the Georgia State Senate in District 31.

Robert Grove v. Brandon Beach

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and held that Brandon Beach is qualified to be a candidate for the Georgia State Senate in District 21.

Lamar Brand v. Richie (Rickie) Smith

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and held that Richie (Rickie) Smith is not eligible to be a candidate for the Georgia House of Representatives in District 151.

Since there is insufficient time to strike Richie (Rickie) Smith's name or reprint the ballots, a prominent notice will be placed at each affected polling place advising voters of Mr. Smith's disqualification. All votes cast for Richie (Rickie) Smith will be void and not counted.

Valencia Stovall v. Yasmin Neal

The challenge to Yasmin Neal's qualifications to be a candidate for the Georgia House of Representatives in District 74 was voluntarily withdrawn, and as such, Secretary Kemp dismissed the challenge.

Charles H. Davis v. Valencia Stovall

The challenge to Valencia Stovall's qualifications to be a candidate for the Georgia House of Representatives in District 74 was voluntarily withdrawn, and as such, Secretary Kemp dismissed the challenge.

Mark Sanders v. Dustin "Dusty" Hightower

The challenge to Dustin "Dusty" Hightower's qualifications to be a candidate for the Georgia House of Representatives in District 68 was voluntarily withdrawn, and as such, Secretary Kemp dismissed the challenge.

Christopher Boedeker v. Carla Roberts

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and held that Carla Roberts is qualified to be a candidate for the Georgia House of Representatives in District 81.

James Trevari v. Garry Guan

Secretary Kemp dismissed the challenge to Garry Guan as a result of Mr. Guan's voluntary withdrawal of his candidacy.

Shennielle Youhoing v. David Scott

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and dismissed the challenge to David Scott's qualifications to be a candidate for United States Representative.

Kelli Persons v. Brooke Siskin

Secretary Kemp adopted the Administrative Law Judge’s findings of fact and conclusions of law and dismissed the challenge to Brooke Siskin's qualifications to be a candidate for the Georgia House of Representatives in District 95.

Brian Kemp has been Secretary of State since January, 2010. Among the office’s wide-ranging responsibilities, the Secretary of State is charged with conducting efficient and secure elections, the registration of corporations, and the regulation of securities and professional license holders. The office also oversees the Georgia Archives.
