Actions Taken by the Georgia State Election Board at its February 24 Meeting

Atlanta—The Georgia State Election Board met Wednesday, February 24, 2010.

The Board voted to close the following cases:

  • SEB No. 2008-000126: Chattooga County
  • SEB No. 2009-000002: DDS
  • SEB No. 2009-000009: Fulton County
  • SEB No. 2009-000024: Randolph County
  • Memo Case 090008: Crawford County
  • SEB No. 2010-000014: Treutlen County

The Board voted to refer the following cases to the Attorney General’s Office:

  • SEB No. 2009-000013: Wilcox County
  • SEB No. 2009-000036: City of Washington
  • SEB No. 2009-000037: City of Comer
  • SEB No. 2009-000040: City of Broxton

The Board voted to accept consent orders in the following cases:

  • SEB No. 2008-000137: Henry County
  • SEB No. 2009-000025: Paulding County
  • SEB No. 2009-000030: Fulton County

In SEB No. 2008-000038 Gwinnett County, the Board voted to refer the case against Baohunh Nguyen to the Attorney General’s Office and issue a letter of instruction to DeKalb County.

In SEB No. 2008-000066 Appling County, the Board voted to close the case against Aushalina Lewis and refer the case against Evelyn Williams to the Attorney General’s Office.

In SEB No. 2008-000109 Greene County, the Board voted to close the case against the Greene County Board of Elections and Registration, and refer the cases against Marion Rhodes and Dorothy Wright to the Attorney General’s Office.

In SEB No. 2008-000117 Gwinnett County, the Board voted to issue a letter of instruction to the Gwinnett County Board of Elections and Registration.

In SEB No. 2008-000118 Clayton County, the Board voted to close the cases against Marciarea Turney, Cybill Shepherd, Mollie Griffin, Stephanie Ifendu, and Tammy Turner; issue a letter of instruction with a cease and desist order and a reprimand to the Clayton County Board of Elections and Registration; and issue a letter of instruction with a cease and desist order and a reprimand to the Clayton County Sheriff’s Department.

In SEB No. 2009-000049 City of Arcade, the Board voted to issue a letter of instruction with a cease and desist order and a reprimand.

In SEB No. 2008-000132 Montgomery County, the Board voted to defer the case for further investigation.

In SEB No. 2009-000020 Cobb County, the Board voted to close the cases against Nancy Duncan, Sung Park, and Adrian Sotres, upon receipt of proof of cancellation of their voter registration; and continue the remaining cases for further investigation.

In SEB No. 2009-000021 Greene County, the Board voted to issue a letter of instruction with a cease and desist order and reprimand to the Greene County Board of Elections and Registration.

In SEB No. 2008-000040 Atkinson County, the Board voted to close the case against Shea Browning and refer the remaining cases to the Attorney General’s Office.

In SEB No. 2009-000034 Morgan County, the Board voted to close the cases against John Milliken and Christopher Murray; the Board voted to refer the case against Steve Burch to the Attorney General’s Office.

The Board voted to accept a consent order for Lowndes County Board of Elections and Registration that covers SEB No. 2008-000133 Lowndes County and SEB No. 2010-000007 Lowndes County; the Board voted in favor of the Secretary of State’s Office conducting an audit on the usage of Oaths that are administered by the counties to ensure proper compliance. In SEB No. 2008-000133, regarding respondent Laura Gallegos, the Board voted to reject the Administrative Law Judge’s initial decision and to give its reasons in the form of findings of fact and conclusions of law; the Board voted to close the case. In SEB 2010-000007, the Board voted to refer the case against Deb Cox to the Attorney General’s Office.

The Board voted to adopt the following rule:
