Georgia law prohibits any person from engaging in the practice or business of a ticket broker if that person
has been convicted of a felony and has not had his or her rights
restored. A
criminal background check must be conducted on each applicant for a new or renewed license. The
results of that check must then be submitted to the commission.
Ticket Broker License Application
Georgia law
requires that prior to obtaining a ticket broker license you must
register with the Georgia Department of Revenue for sales and use tax
purposes pursuant to Article 1 of Chapter 8 of Title 48 – Official
Code of Georgia Annotated. Virtually all
registrations with the Internal Revenue Service as well as with the
Georgia Department of Revenue can now be completed electronically.
“Any
ticket broker offering to resell tickets to an athletic or
entertainment event through any printed, broadcast, or Internet
advertising shall include in such advertising the license number of
such ticket broker offering such tickets for resale.” (O.C.G.A. 43-4B-28)
It’s the law in
Georgia and it will be enforced. This applies to any advertisement and
to any business web site where tickets for events held in Georgia are
sold.
Any Internet based
ticket broker business which offers for sale tickets to events held in
Georgia must either have a license issued by the Georgia Athletic &
Entertainment Commission or must discontinue advertising the
availability of tickets for events held in Georgia.
Broadcast
advertisements must include the tag-line: “Georgia License
Number xxx.” Printed advertisements in newspapers, magazines,
or any other publication, whether they are “classified” or “display”
advertisements, must include the disclaimer: “Georgia License
Number xxx.”
Flyers, posters,
yard-signs, or any other printed advertisement for tickets to events
held in Georgia must include: “Georgia License Number xxx.”
